No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Qualitative evidence concerning the relationship between QoL and a wide range of disabilities suggests that subjective judgments regarding other people’s QoL are wrong more often than not and that such judgments by medical practitioners in particular can be biased. Guided by their desire to do good and avoid harm, surgeons often rely on "the eyeball test" to decide whether a patient will or will not benefit from surgery. But the eyeball test can easily harbor a range of implicit judgments and (...) biases against patients with disabilities, including erroneous assumptions about QoL. We critique the use of the "eyeball" test and offer suggestions to reduce bias and ensure that patients’ values are more consistently prioritized in surgical decision-making. (shrink)

Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. These essays showcase the value of the narrative arts in investigating complex conflicts of value in moral and political life, and explore the philosophical problem of moral dilemmas as expressed in ancient drama, classic and contemporary novels, television, film, and popular fiction. From Aeschylus to Deadwood, from Harriet Beecher Stowe to Harry Potter, the authors show how the narrative arts provide some of our most valuable instruments for complex and sensitive moral inquiry.

In "Frailty Triage: Is Rationing Intensive Medical Treatment on the Grounds of Frailty Ethical?," Wilkinson (2021) argues that the use of frailty scores in ICU triage does not necessarily involve discrimination on the basis of disability. In support of this argument, he claims, “it is not the disability per se that the score is measuring – rather it is the underlying physiological and physical vulnerability." While we appreciate the attention Wilkinson explicitly pays to disability in this piece, we find the (...) distinction between disability and underlying vulnerability untenable both theoretically and practically. In this peer commentary, we begin with a brief overview of research in philosophy of disability concerning the meaning of the concept itself. We argue that this research demonstrates that many forms of disability do not involve underlying vulnerabilities, and, furthermore, that Wilkinson equivocates between "disability" understood as a medical category vs. "disability" understood as a feature of lived experience. We reject Wilkinson’s distinction on these grounds and offer further considerations to avoid disability discrimination in emergency and crisis standards of care contexts. (shrink)

Survival of the fittest in evolutionary biology has a counterpart in the evolution of research paradigms. It’s called survival of the funded, and there is a sense in which paradigms are even more adaptable than species. Rereading Renée C. Fox's “A Sociological Perspective on Organ Transplantation and Hemodialysis,” published in 1970, one is likely to be struck more by continuity than by change. The most pressing of the social, policy, and ethical concerns that Fox raised remain problematic fifty years later. We still struggle with scientific and clinical uncertainty, with the boundary between experimentation and therapy, and with the cost of organ replacement therapies and disparities in how they are allocated. We still have an imperfect understanding (...) of transplant immune responses. We still debate when a potential donor “actually” dies, and we still seem to think better empirical criteria could harmonize the diverse religious, cultural, and socioeconomic values of patients, providers, third‐party payers, and policy‐makers. Organ transplantation was for Fox both a particular case unfolding in time and an entryway for discussing the difficult moral questions presented by many new medical technologies in a context of high demand and limited resources. Buscamos a partir disto, fazer um estudo que vise entender algumas das motivações referentes ao lugar e uso da razão pública pelas religiões na vida social democrática. Para tanto, abordamos a noção de redefinição do significado político da secularização. É inegável que as crenças religiosas e laicas estão vivas e atuantes na esfera pública. (...) Por esta razão, temos que averiguar algo do fenômeno da secularização como projeto de expansão dos axiomas revolucionários da liberdade, igualdade e fraternidade modernas. Logo, vamos seguir nossa argumentação dando atenção para alguns elementos referentes ao pano de fundo histórico-filosófico que contribuíram para a redefinição do significado político deste fenômeno. Todavia, temos que fazer uma articulação teleológica em termos do que seja a soberania popular da ação dos novos sujeitos no limiar das modernas democracias. Ademais, o dado relevante da comunicação e das tensões que envolve o estabelecimento dos consensos sobrepostos, refletem no influxo moral das religiões na esfera pública democrática como um problema conflitivo. Por fim, cotejamos algo referente as epistemologias da suspeição diante da facticidade aporética dos conteúdos religiosos. Isto tem sérias implicações para a construção da identidade do agente humano no devir histórico desta era chamada secular. (shrink)

One of the leading cognitive models of auditory verbal hallucinations (AVHs) proposes such experiences result from a disturbance in the process by which inner speech is attributed to the self. Research in this area has, however, proceeded in the absence of thorough cognitive and phenomenological investigations of the nature of inner speech, against which AVHs are implicitly or explicitly defined. In this paper we begin by introducing philosophical phenomenology and highlighting its relevance to AVHs, before briefly examining the evolving literature (...) on the relation between inner experiences and AVHs. We then argue for the need for philosophical phenomenology (Phenomenology) and the traditional empirical methods of psychology for studying inner experience (phenomenology) to mutually inform each other to provide a richer and more nuanced picture of both inner experience and AVHs than either could on its own. A critical examination is undertaken of the leading model of AVHs derived from phenomenological philosophy, the ipseity disturbance model. From this we suggest issues that future work in this vein will need to consider, and examine how interdisciplinary methodologies may contribute to advances in our understanding of AVHs. Detailed suggestions are made for the direction and methodology of future work into AVHs, which we suggest should be undertaken in a context where phenomenology and physiology are both necessary, but neither sufficient. It is not justifiable to accuse Darwin of conscious or unconscious plagiarism. This charge is contrary to the historical evidence and to the extensive information that we have about his character. When Darwin listed the writers on the origin of species by natural selection before himself, he did not mention Blyth, and this omission did not disturb the cordial relations between Darwin and Blyth. Blyth continued to supply Darwin with information which Darwin used in his later publications with due acknowledgment (...) to Blyth. For example, in The Descent of Man, Darwin cited Blyth: “Mr. Blyth, as he informs me, saw Indian crows feeding two or three of their companions which were blind.”63 Blyth felt no resentment. If he did, he would have so informed Darwin. Blyth did not regard himself as in any sense a predecessor of Darwin and he certainly did not resent Darwin as a plagiarizer of himself. Moreover, Darwin went to a great deal of trouble to find his own predecessors and to give them proper credit.64After Darwin had completed his work on natural selection, he wrote a letter to the Reverend Baden Powell in which he clearly showed recognition of the contribution of others to his own work:No educated person, not even the most ignorant, could suppose I mean to arrogate to myself the origination of the doctrine that species had not been independently created. In his review of Charles Spearman’s The Nature of ‘Intelligence’ (1923), R. G. Collingwood launched an attack upon psychometrics that was expanded in his Essay on Metaphysics (1940). Although underrated by friend and foe alike, Collingwood’s critique identified a number of defects in the thinking of psychometricians that subsequently became entrenched. However, his main complaint was that psychology generally (and, by implication, psychometrics) was a ‘fashionable scientific fraud’. This charge was inspired by his more general views on logic and (...) metaphysics, which, however, as I argue, are logically unsustainable. Ironically, other elements of his philosophy – his ‘fallacy of calculation’ and concept of ‘scale of forms’ – are relevant to psychometrics and tip the scales in favour of his otherwise unwarranted charge. The protagonist of the wildly popular recent video game, The Last of Us, makes a difficult decision at the end of the game by refusing to sacrifice his surrogate daughter so that scientists could try to find a cure for a disease that has devastated humanity for decades. I will take seriously The Last of Us as a piece of moral philosophy and argue that Joel has been interpreted as a villain primarily because many understand morality in terms of (...) a consequentialist or deontological framework. On those frameworks, Joel could be interpreted as a villain because he is not acting in a way that maximizes the good on the one hand or not acting in a way consistent with the universal moral law on the other. Against this interpretation, I argue that Joel’s actions are morally justified based on a view articulated here called teleological particularism. On this view, an agent is morally justified in their actions if and only if the action is in conformity with a role they occupy. It is teleological because it demands that we consider the roles, goals, and purposes of each individual, and it is particularist because it recognizes that those very roles, goals, and purposes can change from subject to subject, time to time, and culture to culture. The role of “father” demands that he protect and provide for the child, and that the father helps the child become autonomous. Joel’s role then demands that he put his child’s interests even above the interests of the rest of humanity, even if those interests are absolutely dire. According to teleological particularism then, Joel is not a villain and his actions in defense of Ellie are permissible. (shrink)

This book argues that human rights are not anathema to MacIntyre’s vision of practices, virtue, and tradition, but rather are necessary to stop that vision being appropriated in problematic ways and to help it take those outside one’s own community seriously. This work brings MacIntyre into extended conversation with historians such as Brian Tierney and Charles Reid as well as with postcolonial thinkers and theologians such as Edward Said and Willie James Jenning, demonstrating that each has something to say (...) to MacIntyre about the limits of virtue’s vision. MacIntyre’s readings of historical theologians, including Ockham and Vitoria, are brought into question, with each being shown to demonstrate how rights can act to complete, rather than undermine MacIntyre’s program. What emerges is a MacIntyrean understanding of rights in which they act as historically discerned constraints against the excesses of institutional power. (shrink)

It has been argued - most prominently in Harry Frankfurt's recent work - that the normative authority of personal commitments derives not from their intrinsic worth but from the way in which one's will is invested in what one cares about. In this essay, I argue that even if this approach is construed broadly and supplemented in various ways, its intrasubjective character leaves it ill-prepared to explain the normative grip of commitments in cases of purported self-betrayal. As an alternative, I (...) sketch a view that focuses on intersubjective constraints of intelligibility built into social practices and on the pragmatics of how those norms are contested in an ongoing fashion. Between the 1930s and the mid 1970s, it was commonly believed that in 1880 Karl Marx had proposed to dedicate to Charles Darwin a volume or translation of Capital but that Darwin had refused. The detail was often interpreted by scholars as having larger significance for the question of the relationship between Darwinian evolutionary biology and Marxist political economy. In 1973–4, two scholars working independently—Lewis Feuer, professor of sociology at Toronto, and Margaret Fay, a graduate student at Berkeley—determined simultaneously (...) that the traditional story of the proposed dedication was untrue, being based on a long-standing misinterpretation of the relevant correspondence. Between the two, and among several other scholars who became their respective allies, there developed a contest of authority and priority over the discovery. From 1975 to 1982, the controversy generated a considerable volume of spilled ink in both scholarly and popular publications. Drawing on previously unexamined archival resources, this article revisits the ‘case’ of the so-called ‘Darwin–Marx correspondence’ as an instance of the phenomenon of ‘multiple discovery’. A familiar occurrence in the natural sciences, multiple discovery is rarer in the humanities and social sciences. The present case of a priority dispute in the history of ideas followed patterns familiar from such disputes in the natural sciences, while also diverging from them in ways that shed light on the significance of disciplinary norms and research infrastructures. This addition—hence the title Mantissa—to the rich vein of information about Constantine Samuel Rafinesque is in fact a supplement to Charles Boewe's own revised and enlarged edition of Thomas J. Fitzpatrick's book Rafinesque .The details of the peripatetic life of Rafinesque, one of America's most original yet undisciplined naturalists, are too well known to bear repeating here. Suffice it to say that because of the vicissitudes of his life—his perpetual wandering between and within Europe and frontier America, his impecunious (...) circumstances that forced him to find different ways of making a living—finding and identifying his publications is a bibliographer's nightmare. Even now, more than 160 years after his death and with the benefit of serious studies by Fitzpatrick and Boewe, as well as by Richard E. Call and Elmer D. Merrill, among others, we can only approximate the number of his publications, including both original titles and republications. Probably we will never have a complete list of Rafinesque's publications because he published regularly in newspapers, broadsides, sales catalogues, privately printed journals, and other ephemera that are infrequently archived. Even his own references to “published” works cannot be trusted as, to him, this term included papers that he sent to journals but were never published. On the other hand, Rafinesque complained to one correspondent that he never knew whether some of these manuscripts were ever published or he learned only years later that they had been. The total number has been estimated at about a thousand, but, as Boewe points out, this number is based on Fitzpatrick's faulty numbering system in which each version of a paper or volume of a multivolume work was given a number. Thus Fitzpatrick's system, continued by Boewe, represents serial numbers, not individual titles. Rafinesque's own estimate was 220, a number Boewe now thinks is a reasonable guess.The Mantissa is an important addition to Rafinesquiana. It lists twenty hitherto‐unrecorded publications by Rafinesque, thirty‐three new translations or reprints, and more than two hundred newly listed secondary references. For the first time we have a list of every manuscript letter written by Rafinesque that is known to exist, and Boewe provides a documented discussion of Rafinesque publications still remaining to be discovered. Several titles known to me, however, are missing from Mantissa, but Boewe's book represents a learned guide for the next scholar willing to take up the challenge and carry on the search. The newly listed manuscript letters will doubtless be particularly helpful in providing leads to undiscovered publications and other facets of Rafinesque's still not completely understood life. Among his correspondents were fellow naturalists such as John James Audubon, Joseph Banks, Benjamin Barton, Charles Bonaparte, Alexandre Brongniart, Augustin de Candolle, Georges Cuvier, Amos Eaton, Asa Gray, William Jackson Hooker, Muhlenberg, Ord, Paolo Savi, James Edward Smith, William Swainson, and John Torrey, as well as prominent leaders of the day, including John Adams, De Witt Clinton, Eleuthère Irénée du Pont, George IV, Thomas Jefferson, and Joel Roberts Poinsett. A total of 346 letters are listed.More important, Boewe has given us the benefit of his many years of scholarly searching and thinking about Rafinesque in his discussions entitled “Hints about Unlisted Titles,” “Letters as a Source of Leads,” and “Hints in Publications.” We learn, for example, that Rafinesque signed some of his papers simply as “Constantine” or “Linneus.” The Mantissa makes it abundantly clear why arriving at a complete account of Rafinesque's writings is an elusive goal, but Boewe shows us that the attempt still offers an exciting trail to follow. This book is a clear, engaging, and ambitious introduction to the philosophy of John Dewey. First, a comment about the subtitle: while I recognize that it reflects the book’s inclusion in a series of “beginner’s guides,” the subtitle (“a beginner’s guide”) is unfortunate. The book is much more than that, and, as such, it is more valuable than the subtitle suggests. It is clearly of help to people new to Dewey, and yet it is also a significant resource for those (...) returning to Dewey in a variety of capacities. For example, this reviewer has found Hildebrand’s book helpful for thinking about pedagogical strategies for teaching Dewey in a recent seminar class (on James and Dewey), and I expect many other teachers will .. Magnetic resonance imaging is a noninvasive imaging tool that utilizes a strong magnetic field and radio frequency waves to visualize in great detail organs, soft tissue, and bone. Unlike conventional x-rays, there is no exposure to ionizing radiation and at most field strengths the procedure is considered safe for nearly every age group. Because it is non-invasive and possesses excellent spatial resolution, the use of MRI as a research tool has increased exponentially over the past decade. Uses have ranged from (...) add-ons to a clinical study to studies of brain development in typically developing children. In addition, a major effort has been made in recent years to use MRI to study brain function. Because the clinical utility of fMRI has not yet been realized, fMRI is still considered highly exploratory, and we cannot yet identify incidental findings of a functional nature. (shrink)
